Changes to Eviction Services for Landlords

Following recent and upcoming changes to Renters’ Rights and the eviction process, it has now become necessary to update our eviction process. This change ensures that eviction services can reflect the changing Tenant & Renters Rights’ Legislations, whilst achieving possession of your property as quickly as possible. 

The changes are:

  • We will continue to serve notices to tenants upon receipt of appropriate instructions from Landlords utilising our Fully Managed services.
  • Where a tenant does not vacate your property by the due date on the notice, we will:
    • Contact the tenant to find out their intentions;
    • Inform you of these intentions and advise you to instruct solicitors to ensure rapid repossession of your property.
  • You are then able to independently instruct soliticors or you can ask us to instruct solicitors on your behalf.
  • After two months’ has past, if no progress towards possession has been made, we will be advising you to refer the case to Grant Saw Solicitors.

Utilising Solicitor Services for Eviction Proceedings

Working with Solicitors Grant Saw, we’re taking the necessary steps to ensure that, where necessary, we can regain possession of your property as quickly as possible.

By using Solicitors to assist with our evictions service, we can ensure that:

  • Our clients are receiving the most appropriate legal advice to help avoid invalidation of the eviction process and to best protect landlords from being required to cover tenant’s legal costs;
  • Our continued management of the eviction process remains well-resourced without distracting from the day-to-day management services that we provide to clients;
  • We can quickly adapt to the changes made by the Renters’ Rights Bill, once this bill becomes law.
  • Our clients, where eviction services are required, can regain possession of their properties at the fastest rate possible.

The fees for this service are as follows:

Fees for Eviction Services

Solicitors Hourly Fee

£300 per hour + disbursements

Optional Eviction Management Service Fee

  • Inclusive of VAT

  • Payable to Jennings & Barrett 

  • You can opt to pay in two parts if additional eviction services are required

10% of total eviction fee payable to solicitors

Professional Hourly Rate

  • Inclusive of VAT

  • Payable to Jennings & Barrett

  • Provides additional services relating to evictions as per the Lettings Management agreement

£100 per hour

What does the J&B management fee cover?  

As your agent, our aim is always to reduce your workload and enable you to spend your time as you choose.

Utilising our eviction management service will provide:

  • Proactive liaison between the solicitors and yourself, ensuring efficient opening of the case, regular updates and effective progression;
  • Provision of documents as required to both solicitors and tenants;
  • Continued communication with tenants and/or their representation/legal aid throughout the process;
  • Ensuring that fees are clearly communicated by solicitors where additional services are required;
  • Arranging for a locksmith to attend the property following the vacation of the property by the tenant;
  • If the property is in a flat within a block, liaising with the property management to ensure that the Landlord can procure entry keys if the tenant fails to return them.

Time to spare to chase solicitors and legal aid representatives? Alternative instruction options:

You can instruct solicitors independently (rather than through us) if you’re happy to:

  • Liaise directly with the solicitors
  • Take responsibility for providing them with the required tenancy documentation
  • Answer calls from council housing teams or Shelter representatives relating to the tenancy and their own documentation requestions;
  • Liaising with bailiffs where this is required to arrange repossession appointments;

In this case, we will continue with day to day tenancy and property management as to your existing instructions, our Landlord Agreement, and our responsibilities. We will not be able to take responsibility for communications between parties regarding eviction proceedings, or for progression services. Please note that all fees mentioned, unless set by Jennings & Barrett and covered within our Landlord terms and conditions and fee structure, are not controlled by us, are exclusive of VAT, and liable to change without notice.  Unlike our fees, Grant Saw’s fees are exclusive of VAT.
